American infanticide, a mother who methodically drowned her five kids in the bathtub on 6/20/2001, Houston, TX. Russell Yates had left home for work at 8:50 AM and Andrea called the Houston police at 9:50 AM to report that she had killed her children

She was the youngest of five kids of Andrew Kennedy, a member of the USAF stationed in Germany at the time of her birth. She attended the University of Houston and UT School of Nursing in Houston. After dating for four years, Andrea and Russell married in April 1993 both about age 28. Noah, the first child was born in February 1994, ten months after the wedding and she quit work. They sold their house and moved in with her parents in October 1998. In June 1999, Andrea made a suicide attempt following the birth of her fourth child, taking an overdose of her dad’s Alzheimer’s medicine at her parents’ Houston home.

A month later they moved into the new house that they bought, one that was actually smaller than the one they had sold. Andrea's dad died on 3/12/2001 at 83; her mom was 72 at the time.

In the months before Andrea Yates drowned her five children, her best friend, Debbie Holmes, testified about her deteriorating mental condition, noting she paced around her suburban Houston home like a "scared animal" in the months before the killings and that she had begged Yates's husband, Russell, to get her immediate help. Debbie talked about her frustration with the lack of care she thought Yates was getting. Although the burdens of family life weighed heavily on Andrea Yates, she got little help from her inattentive husband, Holmes testified.

Yates' husband testified for the defense, saying that he knew his wife was sick. But he said he thought she'd be fine with the children after he left for work that day, because his mother was going to be coming over later to help out. He added that Yates never mentioned to him that she heard voices and saw visions. Defense lawyers called a forensic psychiatrist to the stand, hoping that his comments would bolster their contention that Yates was insane when she drowned her five children in a bathtub. The prosecution's psychiatrist testified that Yates knew right from wrong and was influenced by watching TV.

On March 12, 2002, Andrea Yates was convicted of murder. She showed little emotion at the verdict. However, on January 6, 2005, her capital murder conviction was overturned by an appeals court in Texas because of the false testimony of a witness for the prosecution, the psychiatrist who testified that she knew right from wrong when she drowned her children. The psychiatrist testified that she had seen an episode on “Law and Order,” and was influenced by the TV program. No such program existed. Yates’ mother is pushing for hospitalization instead of a new trial. In the meantime, her attorneys have said they will not seek her release from the prison’s mental health ward where she is receiving medical treatment. Her husband Russell finalized their divorce on March 17, 2005 in Houston.
